About the Webinar

The lifecycle of an SMSF is more often than not a long one, and during that time the ups and downs of life are simultaneously happening to the trustees and members. This session explores the issues that can arise when members and trustees don’t always see eye to eye, and strategies that can be used to minimise any collateral damage, including:

  • The types of disagreements and disputes that can arise between trustees and members that impact the fund
  • How a fund’s deed can address in-house disagreements and disputes
  • Common issues arising since the introduction of the “up to 6 member” fund that are adding to internal disputes
  • Strategies to consider when trustees reach a stalemate, including:
    • when the ATO have a power to assist with resolving a dispute
    • forced exit under deed provisions
    • mediation
    • the court process
  • Implementing the exit of a member when processes or relationships have broken down involving:
    • family members in dispute
    • marital breakdowns
