ABOUT THE RECORDED VIDEO WEBINAR

The Fair Work Act prohibits anyone taking adverse action against someone else because they have (or might exercise) a workplace right. However, employees’ workplace rights are not always clear cut and adverse action can take many forms. This session examines how to minimise the risks of adverse action claims in your workplace, including:

  • How to tell if something is a workplace right?

  • Where do workplace rights begin and end?

  • Types of adverse action that can arise

  • Who can make a claim for adverse action? It’s broader than you think

  • When is adverse action prohibited or unlawful?

  • Avoiding the risks of infringing upon a legitimate right

  • How to minimize the risks of adverse action claims

  • Deed of settlement and release when terminating an employee – the risks and benefits

  • Lessons from recent cases
