However, many trustees have a ‘set and forget’ attitude towards the trust deed. This session examines how to ensure the trust deed is valid and supports the SMSF’s strategies, including:

  • Key provisions in trust deed and importance of trustee awareness
  • Understanding the investment power in the trust deed – is it appropriate?
  • The challenge of keeping the trust deed current:
    • is the trust deed up to date in light of recent developments?
    • does it allow for ‘new’ types of investments such as digital currency?
  • Is the trust deed ambiguous or poorly drafted?
  • The trust deed and death benefits – the issue with power of attorneys
