Determining a child’s best interests is paramount for every family law practitioner specialising in parenting and children’s matters. This session examines some of the more challenging issues associated with determining the best interests of the child and the key factors the Courts will consider. This session will cover:

  • Defining ‘best interests’ – section 60CC FLA
  • Understanding the Court’s approach to determining the child’s best interests
  • Relevance of the child’s views
  • Defining shared responsibility of the child. Who, where and why?
  • Impact of COVID-19 – understanding how the current landscape has changed
  • Addiction, family violence and other potential scenarios – how are they taken into account?
