As lawyers, we are primarily focused on keeping up to date with legal developments to ensure our advice and assistance to clients is up to date. However, the extension of the unfair contract regime to include small businesses means that smaller law firms and sole practitioners will now be caught by the regime. To help lawyers prepare for this change and to ensure they also comply with the regime, this session will explore:

  • The changes to the regime coming into effect in November 2023 with a focus on the provisions applicable to lawyers as service providers
  • What happens when there is non-compliance with the regime including the range of harsher penalties being introduced and how to manage responses if investigated
  • Practical tips and guidance on the steps law firms should take to review their contracts/precedents and maximise their prospects of compliance

Sian provides a sophisticated understanding of all aspects of competition and consumer law including: complex anti-trust litigation, merger clearance, investigations and enforcement action by the Australian Competition and Consumer Commission and other regulators in concentrated and regulated industries. Sian also has extensive expertise advising on Australian third party access and utility infrastructure regimes. Sian has a detailed knowledge of the third-party infrastructure access regime provisions in Part IIIA of the Competition and Consumer Act 2010 (Cth) (CCA), as well as specialist access regimes including Part XIC of the CCA and the National Gas Law. She has a sophisticated understanding of the laws governing access, and has advised both infrastructure access-seekers and access-providers on regulatory issues.

Sian works with clients to always provide clear, risk-based, and timely advice on complex competition and regulatory issues. In recognition of her expertise in the market, Sian has been recognised by Who's Who Legal as one of the future leaders in Competition.
