At both a State and Federal level, governments are grappling with the dilemma that tries to accommodate two sides of the same coin - freedom of religious belief and the prohibition of discrimination against people with different values and beliefs. This session will examine the impact of recent reviews and reforms of discrimination law on schools, including:

  • An overview of the current legal framework and tips on navigating the legal complexities and conflicts
  • Recent developments in State anti-discrimination regimes
  • Recommendation and responses from the Australian Law Reform Commission’s review of religious education and discrimination exemptions
  • What do the reforms mean for the employment of staff in faith-based schools?
  • What do the reforms mean for how schools can deal with students at faith-based schools?
  • What exemptions will religious schools need to rely on to be able to teach in accordance with their values?
  • Strategies for finding a way forward to align school values and legal compliance.

Alistair Macpherson
Managing Director, Vocare Law Brisbane, QLD

Alistair is an Australian Legal Practitioner. He was admitted as a legal practitioner of the Supreme Court of the Australian Capital Territory in 2001 and has experience in the ACT, NSW and QLD jurisdictions.

Prior to entering private practice, Alistair was employed as a legal adviser / solicitor with a number of government organisations (Department of Defence, Australian Federal Police and Department of Primary Industries and Fisheries), as well as working as a prosecutor in the ACT and Queensland.

Since 2006, he has been employed in private practice, and is now the Managing Director of Vocare Law (formerly Corney & Lind Lawyers), a mid-sized law firm with offices in Sydney and Brisbane. Over this period, he has regularly advised independent schools on their legal obligations, as well as acting in various litigious matters against schools (including discrimination, employment, personal injury and contractual disputes). He has served, and continues to serve, on the boards of various independent schools, and is also employed on a part-time basis as the Executive Director, Public Policy and Advocacy for Associated Christian Schools, where he advocates to Government regarding the importance of faith-based education.
