Allan Swan delivers his quarterly estate planning briefing – a must for all estate planning practitioners. In this session, Allan considers 10 succession options for family trusts.

For many clients, a critical aspect of Australian estate planning is determining what happens to the assets held in existing discretionary family trusts, particularly when the next generation includes 2 or more siblings. This webinar looks at the advantages and taxation and other pitfalls of 10 succession options, namely:

  • Sole control by one child (with compensation to the other children via super or personal estate)
  • Sole control of NSW jurisdiction trust by favoured child
  • Sole control of ex-NSW jurisdiction trust by favoured child
  • Conversion of trust into umbrella trust with default distributions to children’s trusts
  • Umbrella trust, but with forward distribution resolutions instead
  • Splitting the trusts into subtrust.
  • Reduction of net assets to nil, eg via asset revaluation reserve
  • Neutral control
  • Provisional winding up, eg when current generation dies
  • Immediate winding up
