This session examines the common, and not-so-common mistakes practitioners make when navigating PPS issues for their clients, including:

  • What categories of agricultural assets can be used as security?
  • Relationship between security interests in crops and interests in land – section 84
  • Crops and livestock as personal property – sections 84A, 85 and 86 PPSA
  • Registration of a security interest the technical requirements and the consequences of not having a valid registration
  • Retention of title clause in sale and purchase contracts – their importance in the PPS context
  • Priority of security interests and the effect on competing claims
  • The length of protection of registration – renewing registration before expiration
  • Consequences of failure to check the register on a purchaser of land or assets
