In November 2023, new laws expanding the unfair contract terms regime come into effect. To avoid the significantly increased and additional penalties the new laws will bring, all businesses caught by the scheme must ensure that all of their contracts are free of unfair contract terms or face the risk of the harsher penalties being introduced. This includes businesses in the building and construction industry. This session will:

  • Provide a general overview of the new unfair contract terms law coming into effect and how they may apply specifically to the building and construction industry
  • Explain which businesses (companies and individuals) will be caught under the expanded scope of the new law focusing on definition of small business
  • Outline the new requirements under the regime for standard form contract and areas of concern for building and construction lawyers
  • Discuss the expanded powers of the courts, issues relating to enforcement, dealing with statements of opinion and representation in the building and construction industry and the impact of these changes on the arguments available in construction contractual disputes, including time bans and liquidated damages

In recognition of his position as a leading government lawyer, Scott was one of the first NSW Law Society Accredited Specialists in Government and Administrative Law (with a focus on government commercial and procurement transactions), and has been appointed by the Law Society of NSW as the Head Assessor for that Specialist Accreditation this year. Scott also writes and lectures two procurement courses for the Masters Programs at both the College of Law and the University of Melbourne.
