Partitioning real property can be an effective way to undertake land development in concert. However, advisers and investors alike need to be aware of the tax and duty interactions with trust and property law. This session considers the duty, GST and income tax issues that can arise when property development is done through partitioning, and explores the following:

  • Transfer duty – which jurisdictions have provisions to manage double transfer duty, and what is required to satisfy the concession?
  • Structuring – is a bare trust one way to manage partitioning issues?
    • what is required for a bare trust to be effective at law and equity? - creation of a trust over future property
    • what is the impact in relation to CGT Event E5? - what is the ATO view on whether there is absolute entitlement?
  • Interaction with strata title – will the partition exemption apply?
  • Practical tips on documentation and evidence to retain
