This session will examine the triggers and issues that should be prompting practitioners to carefully check and amend their client’s deeds, including:

  • Is the trustee acting in accordance with its powers? Does it need additional powers to achieve its goals?
  • Are there adequate mechanisms to deal with the resignation, incapacity or death of the appointor?
  • Does the deed contain effective dispute resolution procedures?
  • Where the trustee is incorporated, does the constitution need reviewing for appropriate decision-making powers and dispute resolution?
  • Does the deed meet best practice modern trust deed requirements?
  • Have legislative changes or judicial decisions impacted on trust arrangements or financial consequences?
  • Is the vesting date coming up and what steps need to be taken before that date?
