About the Webinar

A Death Benefit Nomination (DBN) is often called “a Will for super”, allowing the nomination of those to directly receive the super benefits of the deceased. The consequences of a failure to nominate a beneficiary can be significant, as can the financial ramifications of certain nominations. This session will look at what practitioners need to do to protect the wishes of their clients, including:

  • Taking precedence: treatment of super funds on death and the role of the trustee
  • Binding death nominations – does the deed allow for them?
  • Lapsing and non-lapsing nominations and renewals
  • The consequences of no BDN and trustee discretion: case study of Re Marsella; Marsella v Wareham (No 2) [2019] VSC 65 and Dawson v Dawson [2019] NSWCA 826
  • Types of nomination and eligibility:
  • binding nominations
  • non-binding nominations
  • reversionary nominations
  • Choosing appropriate beneficiaries and tax consequences: who is a dependant?
  • Overruling a binding nomination – court challenges including Re Narumon Pty Ltd [2018] QSC 185
  • Managing the conflict between advisers for the estate and advisers for the super fund
