How can a couple in this situation take steps to protect their pre-marriage or jointly obtained assets while at the same time ensure their respective children can benefit from their estate? This session will look at strategies to manage this dilemma, including:

  • The nature of a life interest and the rights and duties of the holder:
    • How is a life interested created?
    • What rights does it give the holder?
    • Are there any limitation and restrictions?
    • What happens if the holder goes into care? Can the property be sold to pay for a deposit?
    • Remainder interests and Capital Gains Tax implications
    • Tax consequences of relinquishing a life interest
    • What if the children disclaim their remainder interest?
  • A right to reside:
    • What sort of right is it?
    • Who is responsible for the upkeep of the property?
    • When does the right cease?
