About the Webinar

The Tax Office is ramping up its audit activity in relation to trusts and their justified trust program is gradually spreading its wings. Now is a good time to take stock as to the areas of concern the ATO is drilling down on. This session looks at some of the issues, including:

  • Common errors in the drafting of deeds that can lead to adverse tax consequences down the track (Wilstead No. 5 Pty Ltd v Smyth [2020] VSC 651)
  • Invalid distributions (including TD 2012/22 and examples)
  • Tax consequences of ineffective disclaimer of trust distributions by beneficiaries (Carter v Commissioner of Taxation [2020] FCAFC 150)
  • Lessons from Re Owies Family Trust [2020] VSC 716
  • Case study: Tax implications where a trustee treats property development trust on capital account and ATO having a different view, subsequently amending to revenue account
  • Managing loan accounts that come to the fore when implementing an estate plan (McCarthy v Saltwood Pty Ltd [2020] TASSC 19)
  • Lost trust deeds and tips for the appropriate action to take
