Presented by an accredited specialist in both family law and criminal law, we will look at the cross over in relation to the powers of the courts to vary and suspend family law orders in situation involving family violence. This session looks at how to manage these issues effectively from the victim and perpetrator’s perspective and includes:

  • Impact of family violence in parenting matters including initiating proceedings, rebutting the presumptions of equal shared parental responsibility
  • How do state-based family violence orders sit with parenting orders of the Family Court?
    • what happens when there is a family violence order in place but no parenting order?
    • what if there is a family violence order and parenting order in place and they are in conflict?
  • What is the impact of family violence in property matters?
  • Sole use orders versus intervention orders
