This session considers the pros and cons of an inter vivos, pre-death testamentary trust or post-death testamentary trust, including:

  • Pros and cons of each trust structure

  • What are the requirements to establish an effective post-death testamentary trust?

  • Converting inter vivos discretionary trust into a testamentary trust:

    • mechanism triggering distribution immediately before death

    • tax implications of the distribution

  • Implications of the 2018 Budget changes to testamentary trusts:

    • do spouses need to have separate testamentary trusts?

    • is ATO’s current position consistent with the Budget announcements?
