Over recent years, there has been increased interest in the Australian real estate market from overseas buyers.  While this may be positive news for those wishing to offload property, there are complex rules and requirements which come into play when there is a foreign investor. This session shall provide an overview of the rules, practices and procedures that must be followed when it comes to foreign ownership of property and, using case studies, will cover:

  • The definition of foreign and what connection to outside of Australia may trigger Foreign Investment Review Board (FIRB) considerations
  • What interests trigger FIRB -  what exactly is taken to be property e.g. mining permits,  and what property/property rights can be acquired
  • The FIRB application process, relevant exemptions/objection process and thresholds for fees
  • The consequences of breaching FIRB rules for clients, professional advisers and lawyers
