However, with increasing assets, debts and young children, Generation Y should be taking more interest in estate planning, particularly in the event of unexpected death of one partner. This session will provide a guide to practitioners on estate planning issues for a younger generation, including:

  • What are the key considerations and goals in estate planning for a younger family?
  • Analysing the impact of death on the younger family and anticipating future needs
  • Essential insurance cover - who should have what cover and should it be held inside or outside the super scheme?
  • Why intestacy is a problem and key matters to be included in the will, including Child Maintenance Trusts under s 102AG of the ITAA
  • How can superannuation proceeds be most effectively left to dependent family members and in what form?
  • Insurance and super death benefits trusts
  • Tax issues and other financial considerations, including concessions for minors
  • Anticipating and minimising risks where there is a family business operated by one or both partners

Craig’s practice focusses on estate planning, administration and litigation, Court proceedings including will interpretation actions, preparation of commercial agreements including shareholder agreements and business succession agreements for professional practices.

In addition to his role as Principal of Spink Legal, Craig is the Managing Director of Invaulta, a Brisbane based software company providing an online safe custody solution for lawyers and their clients.
