While the ATO has confirmed that property development can be conducted by SMSF trustees they have also noted that it must be done carefully. This session reviews the key issues that arise for SMSF property developments, including:
- The ATO’s concerns in relation to SMSFs conducting property development including those raised in SMSFRB 2020/1
- SIS Act considerations including
- The sole purpose test and Aussiegolfa Pty Ltd (Trustee) v Federal Commissioner of Taxation [2018] FCAFC 122
- Engaging related party builders/developers
- The use of limited recourse borrowing arrangements
- Tax issues including non-arm’s length income rules
- Use of structures by SMSFs to conduct property development
