With companies increasingly unable to comply with their contractual obligations, many clients will be questioning whether the force majeure clauses in their agreements will provide them with a safety net. This session examines how force majeure clauses may be interpreted in the context of a pandemic outbreak, and provides practical advice on what clients should be doing now. It covers:

  • What is a force majeure?
  • Is your force majeure clause adequate to cover a pandemic event?
    • Is a “catch-all” phrase enough?
    • What does an ‘Act of God’ mean and does it cover a pandemic?
  • When will a party be relieved of its obligations?
