An interim injunction is a term often used interchangeably with interlocutory injunction. While both are governed by much the same considerations, the circumstances in which a lawyer should seek, and the Court may grant, an interim injunction order are quite different. This session shall focus specifically on interim injunctions and will look at:

  • The different types of interim injunctions and how best to craft the orders you seek;
  • the relevant factors that need to be balanced when deciding whether or not to advise a client to seek an interim injunction vs an interlocutory injunction;
  • the circumstances in which the Court may grant an interim injunction (and when they won’t); and
  • the finely balanced forensic decisions that need to be made when determining whether or not to seek an interim injunction and practical guidance for how to organise this.
