In modern supply chains, many different stakeholders will buy, finance, transport or sell the same goods several times as they cross many jurisdictions before an end user acquires them. But, what happens when one of the parties in the supply chain becomes insolvent? It can cause a raft of payment problems both up and down the supply chain, and especially when the goods are needed urgently for commercial reasons.
This practical session unravels the issues for stakeholders, including the following:
- Rights and remedies available to stakeholders:
- use of stoppage notices by unpaid sellers under Sale of Goods laws
- rights of providers of storage, logistics and other services
- sellers and financiers rights under the PPSA and other countries' similar laws
