  • Restructuring a family trust – overview of trust splitting and cloning
  • Does the trustee have necessary powers to restructure trusts?
  • Umbrella trusts and creation of sub-trust arrangements
  • Using CGT concessions and rollovers to transfer assets
  • Using loan agreements and capital distributions to achieve similar outcomes
  • The risk of resettlement when amending a trust deed
  • Case update, including McNee v Lachlan McNee Family Maintenance Pty Ltd - [2020] VSC 273
