  • Will the distribution unwittingly trigger capital gains tax?
  • What is the definition of an exempt entity for CGT event K3 to apply?
  • The exception for certain philanthropic testamentary gifts under sec. 118-60 ITAA 1997) and the importance of DGR status
  • If a CGT event occurs for a gifted asset:
  • what is the timing of the event?
  • How is the capital gain or loss calculated?
  • Which entity is assessable on the gain?
  • Does it make a difference if rather than gifting an asset, the executor sells the asset and gifts the proceeds?
  • Practical tips when considering such legacies
