Advisers need to be aware of how to best navigate state and territory taxes, including stamp duty and land tax rules. This session unravels the complexities, including:

  • Issues when assets are held in SMSFs and Trusts:
    • Whose assets are they and who controls them?
    • How do you transfer SMSF and Trust assets to beneficiaries?
    • What are the trust law, SIS, income tax, and CGT consequences of such transfers?
  • the liability of transfers of real estate to duty and stamp duty;
  • the application of the land tax rules;
  • the special position relating to farms and primary production land;
  • Duty and stamp duty exemptions and concessions that can apply to transfers of assets to members and beneficiaries of SMSFs and trusts
