Due diligence is an absolutely critical component of any purchase transaction, but even more importantly so when the intention is to use the land for agricultural purposes. Effective due diligence can be the difference between profit and loss, business success and failure. This session will outline some of the key issues that need to be investigated prior to any property transaction, and tips on risk minimisation, including:
- Can your intentions for the land be realised? Zoning and land suitability
- Will the water resources support use and are there any water rights that need to be included in the acquisition?
- Checking access and third-party rights
- Soil contamination and environmental issues, whether obvious now or arising down track – vendor rectification or other protections
- Managing risk issues through warranties and indemnities
- Leases and licences – important key terms
- Checking the PPSA register
- Options for not proceeding
