    • succession planning
    • sale by an LPR or beneficiary
  • What tax effective options are available to transfer a business to the preferred structure pre death?
  • Is an LPR or beneficiary of a deceased estate eligible for:
    • the small business CGT concessions?
    • the 15 year exemption if the deceased had met the requirements?
  • Is there a taxing event when a taxpayer who has previously utilised the CGT small business rollover dies prior to end of replacement period?
  • How does the active asset test work for an LPR or beneficiary not continuing to carry on the deceased’s business?
  • A review of section 152-80 ITAA 1997 as it applies to CGT assets or interests within 2 years of an individual’s death
