Cases are on the increase for disputes regarding deceased estate and superannuation fund beneficiaries. The disputes can be costly, dissipate funds and lead to unwanted tax consequences. This session covers what can go wrong and where preventative tax planning can help, including:

  • Planning for tax effective distributions from an estate
  • Factoring income tax into entitlements:
  • beneficiaries receiving assets of same value with different contingent tax liabilities (ie. a main residence to beneficiary 1 and an investment property to beneficiary 2)
  • superannuation death benefits and tax applicable depending on status of recipient
  • tax equalization clauses in a will
  • Passing control of trusts and SMSFs’
  • Second spouse issues that may arise
  • Pre death manoeuvring for parents wanting to see benefits before they die or nervous about will being challenged:
  • moving assets pre death
  • tax issues and making use of CGT rollovers
  • Moving wealth out of non estate assets into assets that will form part of the estate:
  • dealing with the tax consequences
  • “Angel of Death” strategy
  • non estate assets ultimately ending up in a testamentary trust
