This session will provide practitioners with drafting skills to pre-empt as far as possible challenges to their client’s wishes, including consideration of:

  • Protecting special needs children – is a trust the answer?
  • The stay at home child – will the house be sold from under him?
  • Estranged family members – the importance of evidence for exclusion from the inheritance, case study: Reg Grundy’s will challenge
  • Arrangements in the event of marriage breakdowns
  • Protecting gifts to charities from challenges
  • Are inter vivos gifts sufficient to preclude a successful challenge? The Bob Hawke case
  • Family agreements and other strategies for heading off claims.
