While off-the-plan contracts are a popular and common way to sell strata units, there are a number of legal issues which can arise and additional steps that must be taken which may come as a surprise to uninformed purchasers. To help your clients make informed decisions when it comes to buying property off-the-plan, this session will:

  • Provide an overview of Division 10 of the Conveyancing Act and the off-the-plan disclosure regime:
    • what is required to comply
    • the role to be played by conveyancers
  • Examine what happens if the plan is updated between exchange and registration, with a focus on material changes and what it means in practice
  • Explore some of the legal issues which often arise and what conveyancers should look out for when dealing with off-the-plan contracts, including inconsistencies with special conditions, and issues regarding rescinding after sunset clause

Peter is an Accredited Specialist in Property Law and manages the Property Department at Campbelltown.

Peter has expertise in many aspects of Property Law including domestic and corporate conveyancing, general property advice work in relation to easements, covenants, restrictions, acting for many developers in relation to large development sites, acting for many councils in relation to general property work and sales and purchases together with sales and purchases of business, business structures, estate planning and general legal practice.

Peter grew up in Campbelltown and went to school at Bradbury Primary, St Gregory's College and John Terry Catholic High School. In 1994, Peter was transferred to the Bowral office, which he managed for a period of four (4) years until his return to the Campbelltown office in 1998. Since Peter's return to the Campbelltown office, he has specialised in property and commercial matters.
