All property purchases have their risks, but buying into a strata development brings with it some challenges. This session provides conveyancers with a guide to key issues and effective due diligence when it comes to acting for a purchaser of an existing strata property, including:

  • Owners Corporation basics – the legislative framework, rights and responsibilities of an OC and recent reforms
  • Tips for dealing with an Owners Corporation, particularly the self-managed, and obtaining relevant information and documentation
  • What is your client purchasing? A discussion of relevant concepts including unit lots, common property and unit boundaries and air rights
  • Legislative disclosure obligations for the sale of strata units and how to interpret certificates – where Owners Corporations get it wrong and consequences for the sale
  • What does a purchaser need to see before buying a strata unit? Doing the due diligence including:
    • developer and building information for more recently completed buildings
    • Owners Corporation rules/by-laws and potential impact on the purchaser’s intentions
    • checking the insurance coverage
    • are there any outstanding claims for defective works or other liabilities?
    • analysing the sinking fund
