The construction industry continues to face challenges arising from the fixed price contract model, costs of materials and energy, interest rates, supply chain disruptions and the costs and availability of skilled labour. This session will explore how to deal with insolvency of a party on a construction project, including:

  • An overview of corporate insolvency law, practice and procedure in a construction context
  • How insolvency impacts the different levels of the contractual train differently, from the principal down to sub-contractors (and everyone in between)
  • Risk minimisation strategies at various stages of a project
  • Practical options to consider when acting for a party in a construction project where another party is, or at risk of being, insolvent
  • What to consider when builders or contractors ask for financial assistance without a contractual entitlement

Sam specialises in insolvency and restructuring, working with clients in all aspects of external administrations, security enforcement and insolvency dispute resolution. He has acted for clients in a wide range of industries in large scale court proceedings involving complicated insolvency issues and Personal Property Securities Act 2009 (Cth) claims.

Sam also has extensive experience in a diverse range of regulatory issues and investigations, including dealings with regulatory bodies like ASIC and AFCA. He has detailed experience in Royal Commissions and was previously the Principal Legal Officer of the Queensland Racing Commission of Inquiry.
