In 2020, sections 588FDB and 588FE(6B) were introduced into the Corporations Act to prohibit phoenix activity. In 2022, in the first case of its kind in Australia, those provisions were the subject of judicial determination in the Supreme Court in Victoria in Re Intellicomms. This session will examine:
- The background to the introduction of the anti-phoenixing amendments and the outcome they were trying to achieve;
- The factual history of the case, the interplay with the anti-phoenixing provisions and the issues requiring judicial determination
- The impact of the Supreme Court of Victoria’s decision and the importance of the decision for identifying a credit defeating disposition under s588FDB of the Corporations Act in the future
