The revised unfair contract terms regime commenced operation on 9 November 2023. What the new laws mean for the finance sector and what steps should immediately be taken to ensure compliance are questions that are, or should be, at the forefront of everyone’s mind – particularly considering the potential severity of the penalties that have been introduced and the breadth of capture for the expanded regime. This session will:

  • Provide a summary of the new unfair contract terms laws, including which businesses and types of contracts may be caught under the expanded scope of the regime;
  • Discuss the anticipated impact on, and flag areas of concern for, participants in the finance sector; and
  • Explore practical steps that should be taken to promote compliance with the new laws, including tips for contract and precedent review.

Tomaso Di Lallo
Barrister, Victorian Bar Melbourne, Vic.

He is experienced in interlocutory, trial and appellate advocacy, primarily in the Supreme Court of Victoria and the Federal Court of Australia.  Tomaso’s principal areas of practice are in insolvency, banking, contract, corporations, equity, property, restitution and trade practices. 

Because of his accounting background, Tomaso has particular proficiency in accounting and financial matters.  As a result, he has been retained in many proceedings in which familiarity with accounting documents is essential, and has extensive experience in working with expert witnesses in such matters. 

Tomaso has experience in class action litigation, with a particular focus on securities class actions.  In this dynamic and constantly evolving area of law, he has been retained by major national and international law firms, from the earliest stages, in organising establishing and conducting securities class actions against publicly listed companies. 

Tomaso was employed at Arthur Robinson & Hedderwicks (now, Allens).  Subsequently, he was Associate to the Honourable Sir Reginald Smithers of the Federal Court of Australia, and thereafter was employed at Madden Butler Elder & Graham (now, Norton Rose Fulbright). 

Tomaso holds a Bachelor of Laws with Honours and a Bachelor of Economics with Honours, majoring in accounting, from Monash University.
