In March 2021 the new provisions in section 14 of the Mental Health and Cognitive Impairment Forensic Provisions Act came into effect, designed to make significant changes to the finding of mental illness, the making of diversion orders and allowing for clearer determinations. This session will examine how the new legislation is working in practice, including:

  • How the new Act is intended to improve on the previous law and procedures – recommendations of the NSW law Reform Commission
  • Unpacking the major changes
  • How has the change to statutory defined illnesses and conditions been received?
  • What impact is the new model on fitness for trial having on numbers being sent to trial or otherwise sent to a special hearing or the Tribunal?
