The use of artificial intelligence (AI) to create business efficiencies and improved production is growing considerably, but the regulatory framework for registration, use and protection of data it creates remains largely under-developed, with reliance being placed on existing laws in the absence of specific regulation. This session explores the application of intellectual property laws to AI and proposed reforms in the sector, including:

  • What is AI and what does it do? How is data created?
  • Who owns the data created by AI?
  • Can the data created by AI be a work under the Copyright Act?
  • A discussion of authorship and cases on computerised data creation including Telstra Corp Ltd v Phone Directories Co Pty Ltd [2010] FCA 44
  • Can AI creation be the subject of a patent? Commissioner of Patents v RPL Central Pty Ltd [2015] FCAFC 177 and developments since then in the computerization of devices and systems
  • Treatment of AI data as a trade secret and appropriate contractual safeguards
  • Developing corporate policies and procedures for management and risk issues arising from data creation and use, including data security
  • Developments overseas in the recognition of computer-generated works under copyright laws
  • The rise of the concept of “big data” and reforms in consumer data access
  • Case study: the ownership and use of data in agribusiness
