Recorded Webinar: Verification of Identity: Key Compliance Risks for Property Lawyers (Qld)
Date/Time
About the Webinar
The days are long gone when practitioners knew their clients personally and operated exclusively within the borders of their town or State. As a result, the Verification of Identity (VOI) process for participation in PEXA takes on an increased risk, with the onus squarely placed on property lawyers. This session provides advice on the risks associated with VOI and guidance on compliance obligations, including:
- An overview of the VOI Standard and responsibilities of practitioners and identity agents
- Navigating the right to deal
- The ARNECC Model Participation Rules consultation and compliance statements
- A consideration of what constitutes the “reasonable steps” required for verification
- What are satisfactory alternatives to face-to-face interviews?
- Red flags and risk issues and how to respond
- Potential consequences of inability to inspect hard copy documentation
- The role of third-party agents and associated issues with using them
- Advice for dealing with off-shore purchasers and vendors
- Who is liable in the event of fraud or scams? Will professional indemnity insurance cover you?
- Advice and guidance for achieving VOI compliance
